Sooner or later all C-53 builders are involved in a construction defect litigation claim. Sometimes, these claims can cover multiple policy periods and it is typical that more than one insurance carrier will be involved in the defense. Once the claim has been resolved and settled the builder is only responsible for paying ONE deductible. They may also choose which deductible to pay.
For example, if you have a deductible of $1,000, $2,000, and $5,000 because the project was covered by three different policies during the project, you can choose to only pay the $1,000 deductible. That would be a difference of $7,000 more out of pocket if you didn’t know your rights.
